Booking Terms & Conditions

1. Introduction and Acceptance of Terms
These Booking Terms & Conditions (“Terms”) govern every travel reservation made through Travelingos, the trade name of DNA Travel LLC, a limited liability company organized under the laws of the State of Wyoming (“Travelingos,” “we,” “us,” or “our”), including bookings made via our website, by phone, by email, or through any other channel we make available to customers in the United States and Canada.
By approving a price quote, submitting a booking request, or completing payment-whether for yourself or on behalf of any other traveler included in the reservation-you (“Traveler,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
Voucher Supremacy. Where Travelingos issues a Voucher (as defined below) to confirm a specific reservation, the Special Conditions stated in that Voucher shall govern and control with respect to that reservation. In the event of any conflict or inconsistency between these Terms and the Special Conditions in a Voucher, the Voucher’s Special Conditions shall prevail.
2. Definitions
“Voucher” means the written confirmation document issued by Travelingos upon completion of a booking, setting out the specific details and any Special Conditions applicable to that reservation.
“Special Conditions” means any terms, restrictions, or conditions set out in a Voucher that supplement or modify these Terms with respect to a particular booking.
“Supplier” means any hotel, accommodation provider, bussing company, driver, tour operator, excursion provider, activity provider, airline, or other third-party vendor whose services are booked through Travelingos.
“Services” means the accommodation, travel, flight, excursion, meal, or any other activity bookings facilitated by Travelingos on behalf of Suppliers.
“Booking” means any reservation for Services confirmed by Travelingos on your behalf.
3. Travelingos’ Role as Travel Intermediary
Travelingos acts solely as an intermediary agent. We facilitate reservations between Travelers and Suppliers; we do not own, operate, manage, or control any hotel, accommodation, tour, excursion, airline, or other travel product offered through our platform.
Each Supplier’s own terms and conditions, cancellation policies, and operational rules apply to the services they provide. By proceeding with a booking, you acknowledge that the relevant Supplier’s terms, as communicated to you at or prior to booking, form part of the contract governing that service.
Travelingos shall not be liable for any act, omission, breach, negligence, default, insolvency, or misconduct of any Supplier, nor for any loss, damage, injury, or disappointment suffered as a result of your reliance on a Supplier’s services.
4. Bookings and Confirmation
4.1 Booking Process
A Booking is not confirmed until you have received a Voucher from Travelingos. Verbal representations, price quotes, or preliminary emails do not constitute a confirmed Booking.
You are responsible for verifying that all information included in your Booking-names of travelers, travel dates, flights, accommodation details, excursion selections, and any other Service-is accurate before payment is submitted. Travelingos is not responsible for errors that you fail to identify prior to confirmation.
4.2 Traveler Information and Documents
All traveler names and personal details must exactly match valid government-issued identification. You are solely responsible for ensuring that all travelers hold valid passports, visas, travel authorizations, or any other entry documents required for their destination.
Travelingos will not be liable for any costs, losses, or denied entry resulting from a Traveler’s failure to hold appropriate travel documents. You are encouraged to consult the U.S. Department of State (travel.state.gov) and the relevant destination authority for current entry requirements.
4.3 Confirmation Number and Voucher
A hotel confirmation number will generally be provided within 5-10 business days of full payment. Timing depends on the Supplier and may vary by season. The absence of a confirmation number does not indicate that a booking does not exist-it indicates that the Supplier has confirmed the room category but has not yet assigned a specific reservation number in its system. Travelingos will make reasonable efforts to provide confirmation promptly.
4.4 Age Requirement
The person making a Booking must be at least 18 years of age. By submitting a Booking, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding contract. Travelingos reserves the right to cancel any Booking made by a person who does not meet this requirement, without refund.
4.5 Prohibited Bookings
You may not make speculative, false, or fraudulent Bookings. Bookings must be made for genuine travel purposes only. Travelingos reserves the right to cancel without refund, and to report to relevant authorities, any Booking it reasonably believes to have been made fraudulently, with false or inaccurate information, or for purposes of inventory manipulation or resale without Travelingos’ prior written consent.
5. Hotels and Accommodation
5.1 Reservation Changes
After a Booking is confirmed, any change, including room type, number of guests, travel dates, or length of stay-may require cancellation of the existing reservation and creation of a new one. Travelingos cannot guarantee that the original price, room type, or availability will remain valid following a change request. All changes are subject to hotel policies and availability.
5.2 Cancellations
Free-cancellation bookings: Where a Booking includes a free-cancellation period, cancellation must be requested and processed before the free-cancellation deadline stated in the Voucher. Full payment remains due no later than thirty 35-30 days prior to check-in unless otherwise specified in the Voucher.
Non-refundable bookings: Where a Booking is designated as non-refundable or where the free-cancellation deadline has passed, any request to change or cancel the reservation is subject solely to the Supplier’s discretion. Travelingos will assist in submitting such requests but bears no responsibility for the outcome.
Exceptional circumstances: In cases involving documented exceptional circumstances (such as serious illness or death of an immediate family member), the Traveler must provide formal written documentation. Even with such documentation, any approval or refund remains at the Supplier’s discretion, and Travelingos assumes no liability.
Non-payment cancellations: Any Booking not paid in full by the required deadline may be automatically canceled up to seven (7) days before the free-cancellation deadline, without further notice. Where partial payment has been made, a refund of the amount paid will be processed, subject to Supplier confirmation.
5.3 Check-In Issues
If, upon arrival, the hotel cannot locate your reservation, you must immediately contact Travelingos at +1-877-515-3978 (option 3 – urgent matters) or by email at support@travelingos.com. Failure to notify us immediately may limit our ability to assist. If you independently arrange alternative accommodation without first contacting us, Travelingos will not be responsible for any additional costs incurred.
5.4 In-Stay Complaints
If you are dissatisfied with the accommodation after check-in, you must immediately address the issue directly with the hotel’s front desk and request resolution, early checkout, or cancellation. Failure to raise concerns during the stay, rather than after departure, may limit any remedies available.
If the hotel approves an early cancellation and refund, you must obtain written confirmation from the hotel explicitly stating both cancellation and refund approval, including the name of the hotel representative who authorized it. Travelingos will submit a refund request to the Supplier only upon receipt of such written confirmation.
5.5 Local Taxes and Resort Fees
Hotels may require payment of local taxes, resort fees, or other charges at check-in. Travelingos will make reasonable efforts to inform you in advance where such fees are known, but these charges are determined solely by the hotel and may change. Travelingos is not responsible for additional charges imposed at check-in.
5.6 Hotel Quality and Accuracy
Travelingos facilitates reservations based on information provided by Suppliers. You are responsible for independently reviewing hotel details, room descriptions, policies, and guest reviews before booking. Travelingos does not guarantee hotel quality and is not responsible for dissatisfaction relating to cleanliness, service, maintenance, or unmet personal expectations.
6. Excursions, Tours, Transfers, Transportation and Activities
6.1 Nature of Services
Travelingos facilitates bookings for tours, excursions, transfers, transportation, and activities operated by independent Suppliers. Travelingos does not operate or control these activities and is not responsible for their safety, execution, equipment, or cancellation by the Supplier.
6.2 Participation and Eligibility
By booking an excursion, transfer, transportation, or activity, you confirm that all participating Travelers are in suitable physical and mental condition to participate safely. You are responsible for disclosing all relevant medical conditions to the Supplier prior to participation. Failure to disclose relevant medical conditions may result in denial of participation without refund.
All Travelers must follow the instructions and safety guidelines provided by the operator. Failure to comply with operator instructions may result in removal from the activity without refund.
Participation in tours or activities may involve physical exertion, inherent risks, or adventurous elements. Participation is voluntary and at the Traveler’s own risk.
6.3 Supplier Cancellations and Changes
Excursions, transfers, transportation, and activities are subject to cancellation or modification by the Supplier due to weather, safety concerns, force majeure, or other operational factors beyond Travelingos’ control. In such cases, Travelingos will make reasonable efforts to notify you promptly and assist with alternative arrangements or refund requests, subject to Supplier policy.
7. Flight Reservations
7.1 Travelingos’ Role in Flight Bookings
Where Travelingos facilitates the booking of airline tickets on your behalf, it does so solely as an intermediary agent between you and the operating airline. The airline ticket constitutes a direct contract of carriage between the passenger and the airline. Travelingos is not a party to that contract and is not responsible for the airline’s performance, policies, or decisions.
7.2 Airline Schedules and Operational Changes
Flight schedules, routes, stopovers, operating carriers, aircraft type, and departure or arrival times may change after a Booking is confirmed. Such changes are outside the control of Travelingos. You are responsible for checking your flight details-including any updates communicated directly by the airline-prior to travel.
Schedule changes and cancellations: Responsibility for flight delays, cancellations, denied boarding, overbooking, and schedule changes lies solely with the operating airline. In such cases, re-accommodation, compensation, and remedies are governed by the airline’s own policies and applicable law (including, where relevant, U.S. Department of Transportation regulations) and are handled directly between you and the airline. Travelingos will provide reasonable assistance in facilitating communication with the airline but has no authority to compel remedies on your behalf.
7.3 Traveler Names and Identification
All passenger names on flight tickets must exactly match the name on the traveler’s valid government-issued photo identification or passport. You are solely responsible for ensuring that all passenger details are accurate at the time of booking. Name changes after ticketing may not be possible and, where permitted by the airline, may incur significant fees. Travelingos is not responsible for costs arising from name discrepancies.
7.4 Travel Documents and Entry Requirements
Each traveler is solely responsible for obtaining and carrying all required travel documents, including valid passports, visas, electronic travel authorizations (such as ESTA for travel to the United States), and any health-related documentation required by the destination country. Travelingos will make reasonable efforts to bring known requirements to your attention but cannot guarantee the accuracy or completeness of entry requirement information, which is subject to change. You are encouraged to verify all requirements directly with the relevant embassy, consulate, or government authority.
7.5 Special Requests
Special requests relating to flights-including seating preferences, meal selections, wheelchair assistance, or unaccompanied minor arrangements-are forwarded to the airline on a request-only basis. Travelingos cannot guarantee fulfillment of any special request, and fulfillment remains entirely at the airline’s discretion.
7.6 Check-In, Boarding, and Baggage
You are solely responsible for complying with the airline’s check-in deadlines, boarding procedures, and baggage allowance rules. Travelingos is not responsible for any costs, losses, or missed travel caused by late arrival at the airport, failure to meet check-in requirements, or excess or prohibited baggage.
Responsibility for baggage loss, delay, or damage rests solely with the operating airline. Claims for baggage issues must be raised directly with the airline at the time of the incident, in accordance with the airline’s procedures.
7.7 Code-Share Flights
Some flights may be operated under a code-share arrangement, meaning the flight is marketed under one airline’s code but operated by a different carrier. Where applicable, the identity of the operating carrier will be disclosed at or before booking. Travelingos is not responsible for any differences in service, equipment, or policies between the marketing and operating carriers.
7.8 Flight Ticket Refunds and Changes
Flight ticket refund and change eligibility depends entirely on the fare rules of the ticket purchased. Non-refundable and non-changeable tickets are common, particularly for lower-priced fares. You are responsible for reviewing fare rules before completing payment. Where a change or refund is permitted under the applicable fare rules, Travelingos will assist in submitting the request to the airline, but approval and processing timelines are controlled by the airline and cannot be guaranteed. Any airline-imposed fees, fare differences, or penalties are your responsibility.
8. Prices, Payment, and Refunds
8.1 Pricing
All prices quoted by Travelingos are valid at the time of quotation and are subject to change until full payment is received and a Voucher is issued. A price is guaranteed only upon completion of full payment and issuance of a Voucher confirming the Booking.
Prices are in U.S. dollars unless otherwise stated in the Voucher. Applicable taxes and fees will be disclosed at or prior to booking to the extent known.
8.2 Payment
Payment terms, deadlines, and deposit requirements will be specified in your price quote and/or Voucher. You are solely responsible for completing payment by the required deadline. While Travelingos may send payment reminders as a courtesy, the responsibility for timely payment rests entirely with you.
8.3 Refunds
Refunds are issued solely in accordance with the Supplier’s applicable cancellation policy and these Terms. Approved refunds will be processed to the original payment method after the Supplier has confirmed the refund and Travelingos has received the refunded funds. Refund processing may take up to 20 business days to appear on your bank or credit card statement following Supplier confirmation.
Travelingos will make reasonable efforts to resolve refund matters within 30 business days, but timelines depend on Supplier responsiveness and cannot be guaranteed.
8.4 Credit Card Disputes and Chargebacks
Contact Travelingos first. Before initiating a chargeback or payment dispute with your credit card issuer or bank, you agree to contact Travelingos in writing at support@travelingos.com and allow us a reasonable opportunity-no less than fifteen (15) business days-to resolve the matter in accordance with these Terms and applicable Supplier policies.
No double recovery. If you have initiated a chargeback with your card issuer for a charge related to a Booking, Travelingos will suspend processing of any concurrent refund request for the same charge pending resolution of the dispute. You are not entitled to both a chargeback recovery and a separate refund from Travelingos for the same transaction.
Unwarranted chargebacks. If you initiate a chargeback that is subsequently found by the card issuer to be unwarranted, or if you initiate a chargeback in circumstances where the charge was valid under these Terms, Travelingos reserves the right to contest the chargeback and to recover from you any amounts refunded together with all reasonable costs incurred in disputing the chargeback, including chargeback fees imposed by the card issuer or payment processor.
Effect on future bookings. Travelingos reserves the right to cancel any pending Booking and decline to process future bookings from any Traveler who has initiated an unwarranted chargeback, until the disputed amount and any associated costs have been repaid in full.
9. Cancellation by Travelingos
Travelingos reserves the right to cancel a Booking in exceptional circumstances, including (without limitation) if a Supplier ceases operations, if a destination becomes unsafe, or if pricing errors are identified prior to confirmation. In such cases, Travelingos will provide prompt notice and, where applicable, issue a full refund of amounts paid or assist with rebooking.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- Travelingos is not liable for any act, omission, or default of any Supplier, including but not limited to hotel closures, poor service, accommodation that does not match the description, activity cancellations, flight delays or cancellations, denied boarding, baggage loss, or injuries sustained during tours or activities.
- Travelingos is not liable for any loss, injury, death, damage, or expense arising from causes beyond our reasonable control, including acts of God, natural disasters, pandemics, acts of terrorism, government actions, civil unrest, or other force majeure events.
- In any event, Travelingos’ maximum liability to you with respect to any single Booking shall not exceed the total amount paid by you to Travelingos for that Booking.
- Travelingos is not liable for any indirect, incidental, consequential, special, or punitive damages of any kind.
Nothing in these Terms shall limit or exclude Travelingos’ liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be excluded or limited under applicable U.S. federal or state law.
11. Assumption of Risk, Release, and Indemnification
By booking a tour, excursion, or activity through Travelingos, you voluntarily assume all inherent risks associated with such activity, including physical injury, illness, death, or property damage. To the fullest extent permitted by law, you release and hold harmless Travelingos and its officers, employees, and agents from any claim arising from your participation, except to the extent caused by Travelingos’ gross negligence or willful misconduct.
You agree to indemnify, defend, and hold harmless Travelingos and its officers, employees, and agents against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) the acts or omissions of any Traveler included in your Booking.
Minor Travelers: By booking on behalf of a minor (any person under 18 years of age), the parent or legal guardian confirms acceptance of these Terms on the minor’s behalf and assumes full responsibility for the minor’s participation in any Services booked.
12. Travel and Health Insurance
Travel insurance is not included in any Booking. Travelingos strongly recommends that all Travelers purchase comprehensive travel insurance before their trip, including coverage for trip cancellation, medical emergencies, emergency evacuation, baggage loss, and-where applicable-adventurous or extreme activities.
Any insurance policy purchased is a separate contract between the Traveler and the insurer. Travelingos is not a party to any insurance arrangement and bears no responsibility for coverage determinations or claim outcomes.
13. Travel Advisories and Destination Information
Travelingos does not provide travel advisories, health warnings, or destination-specific risk assessments. Before traveling, you are solely responsible for consulting your government’s official travel advisory resources-for U.S. travelers: travel.state.gov; for Canadian travelers: travel.gc.ca-and for seeking appropriate medical advice regarding your destination.
Travelingos is not liable for any loss, injury, expense, or inconvenience arising from destination-specific risks, including political instability, crime, natural hazards, disease, or public health conditions, whether or not a government travel advisory was in effect at the time of booking or travel.
14. Force Majeure
Travelingos shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including without limitation: natural disasters, pandemics, epidemics, acts of government, war, terrorism, civil unrest, strikes, or infrastructure failures. In such circumstances, Travelingos will use reasonable efforts to minimize disruption and assist with alternative arrangements, subject to Supplier availability and policy.
15. Intellectual Property
All content on the Travelingos website and platforms-including text, photographs, graphics, logos, and booking interfaces-is the property of Travelingos or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or exploit any such content without prior written consent from Travelingos.
16. Privacy
Travelingos collects and processes personal information in accordance with its Privacy Policy, available at www.travelingos.com. By using our services, you consent to the collection and use of your information as described in that policy. Travelingos may share your personal information with Suppliers to the extent necessary to fulfill your Booking.
17. Canadian Customers
Currency. All prices are quoted in U.S. dollars. Canadian customers are responsible for any currency conversion costs or exchange rate fluctuations charged by their financial institution.
Mandatory consumer protection laws. Nothing in these Terms limits or excludes any right you may have under the mandatory consumer protection legislation of your Canadian province or territory that cannot be waived by contract. To the extent of any conflict between these Terms and such mandatory provisions, the mandatory provisions prevail.
Quebec – Language. Conformément à la Charte de la langue française du Québec, Travelingos met ces conditions à la disposition des résidents du Québec en français sur demande adressée à support@travelingos.com. (Translation: In accordance with Quebec’s Charter of the French Language, Travelingos will make these Terms available in French to Quebec residents upon request at support@travelingos.com. Quebec residents also have rights under the Quebec Consumer Protection Act that apply to distance contracts and cannot be waived.)
18. Electronic Communications
By making a Booking or using Travelingos’ services, you consent to receive communications from Travelingos electronically, including by email or through our website. You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. For Canadian customers, this choice of law does not deprive you of the protection of any mandatory provisions of the consumer protection laws of your province or territory.
19.2 Informal Resolution
Before initiating any formal proceeding, you agree to contact Travelingos in writing at support@travelingos.com and provide a concise description of the dispute and the resolution you seek. Travelingos will attempt to resolve the matter within 30 days of receipt.
19.3 Arbitration
If the dispute is not resolved informally, any controversy or claim arising out of or relating to these Terms or any Booking shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, then in effect. Arbitration shall take place in New York, New York, or by written submissions if you prefer. The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction. This arbitration agreement applies to the fullest extent permitted by applicable law; where mandatory local law requires access to a court or does not permit binding arbitration of consumer disputes, that law shall prevail.
Class Action Waiver: To the fullest extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration with respect to any claim against Travelingos. All claims must be brought in your individual capacity.
20. Modifications to These Terms
Travelingos reserves the right to update or modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. If you have an existing Booking, the Terms in effect at the time your Voucher was issued will continue to apply to that Booking, unless otherwise required by law.
21. General Provisions
Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Entire Agreement. These Terms, together with the Voucher (including any Special Conditions set out therein) and any Supplier terms communicated to you at booking, constitute the entire agreement between you and Travelingos with respect to your Booking and supersede all prior representations, discussions, or agreements.
Waiver. No failure or delay by Travelingos in exercising any right or enforcing any provision of these Terms shall constitute a waiver of that right or provision. A waiver is effective only if made in writing and signed by an authorized representative of Travelingos.
No Third-Party Beneficiaries. These Terms are for the sole benefit of the Traveler (and Travelers party) and Travelingos and do not confer any rights or remedies on any third party.

ACKNOWLEDGMENT AND ACCEPTANCE
By approving a price quote, confirming a Booking, or completing payment, the Traveler, on their own behalf and on behalf of all travelers included in the reservation, confirms that they have read, understood, and agreed to these Booking Terms & Conditions in their entirety, including any Special Conditions set out in the applicable Voucher. This act constitutes the Traveler’s legally binding acceptance of these Terms.
